Description of Duties:

Performs highly responsible professional legal and administrative work for the Board of Nursing. Will review all cases for potential disciplinary action. In conjunction with the Board=s investigators, will prepare Notices of Hearings, Agreed Board Orders, Board Orders, Interrogatories and other legal documents relating to formal and informal disposition of contested cases and administrative proceedings. Will file charges in accordance with applicable law and rules of the agency. Will draft rule changes, respond to open records request and draft requests for AG opinions. This position will be primarily responsible for resolving assigned contested cases through settlement negotiation and alternative dispute resolution, including mediation at the State Office of Administrative Hearings.  The successful candidate will be expected to work independently and exercise good professional judgment with moderate direction and supervision.  Further, this position will review complaints and investigations for legal sufficiency and provide legal advice and recommendations to Board Staff. General Qualification Requirements:

Experience and Training:

Ability to speak and write effectively and to maintain communications while enforcing rules and regulations.  Knowledge of federal and state laws affecting the agency as well as agency policies and procedures.  Experience in administrative, civil and/or criminal practice preferable.  Experience in the health care field and/or nursing preferable.  Strong academic background may substitute for experience in administrative law and/or health care law.


J.D. Degree from an accredited university law school is required.


Must have a current license to practice law in the State of Texas.

Additional Requirements:

Applicants must attach a sample of a legal writing prepared within the last three years of practice as an attorney or as a law student.  Also required is a statement, no more than one page, analyzing how your experience and abilities prepare you for this position, a resume and name and addresses of three current professional references.
